Please read these Terms of Service (“Terms”) carefully before using the Schengenly mobile application (“App”) operated by Schengenly (“we,” “us,” or “our”).

Acceptance of Terms

By downloading, installing, or using Schengenly, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use the App.

Description of Service

Schengenly is a travel tracking application that helps users monitor their stays in the Schengen Area. The App calculates days spent within the Schengen zone based on user-entered data to assist with compliance with the 90/180-day rule.

Important Disclaimer

Schengenly is an informational tool only. The App:

  • Does not provide legal, immigration, or visa advice
  • Does not guarantee accuracy of calculations
  • Should not be relied upon as the sole source for immigration decisions
  • Is not affiliated with any government or immigration authority

You are solely responsible for verifying your visa status and compliance with applicable immigration laws. Always consult official government sources or qualified immigration professionals for authoritative guidance.

User Responsibilities

By using Schengenly, you agree to:

  • Provide accurate entry and exit dates
  • Verify calculations independently before making travel decisions
  • Keep your app and device secure
  • Not use the App for any unlawful purpose
  • Not attempt to reverse engineer, modify, or distribute the App

Account and Data

Local Data

You are responsible for backing up your local data. We are not liable for data loss due to device failure, app deletion, or other causes.

Cloud Sync

If you use cloud sync features:

  • You are responsible for maintaining the security of your device
  • We may suspend or terminate sync services for violations of these Terms
  • You can delete your cloud data at any time

Intellectual Property

The App, including its design, code, graphics, and content, is owned by Schengenly and protected by intellectual property laws. You may not:

  • Copy, modify, or distribute the App
  • Use our trademarks without permission
  • Remove any copyright or proprietary notices

Limitation of Liability

To the maximum extent permitted by law:

  • The App is provided “as is” without warranties of any kind
  • We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose
  • We are not liable for any damages arising from your use of the App
  • We are not responsible for immigration violations, fines, deportation, or other consequences resulting from reliance on the App

In no event shall our total liability exceed the amount you paid for the App (if any).

Indemnification

You agree to indemnify and hold harmless Schengenly, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights

Changes to the App

We reserve the right to:

  • Modify or discontinue the App at any time
  • Update features, functionality, or pricing
  • Change these Terms with notice through the App or website

Continued use after changes constitutes acceptance of the new Terms.

Termination

We may terminate or suspend your access to the App immediately, without prior notice, for:

  • Violation of these Terms
  • Conduct that we determine is harmful to other users or our interests
  • Any other reason at our sole discretion

Upon termination, your right to use the App ceases immediately.

Governing Law

These Terms are governed by the laws of the jurisdiction in which Schengenly operates, without regard to conflict of law provisions.

Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

  1. Good faith negotiation
  2. Mediation
  3. Binding arbitration (if negotiation and mediation fail)

You waive any right to participate in class action lawsuits against Schengenly.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Schengenly regarding the App.
